The parties have reached a settlement to resolve the District of Columbia’s lawsuit, entitled District of Columbia v. Power Design, Inc., et al., No. 2022-CA-001977-B (D.C. Super. Ct. 2022), against: Power Design; John Moriarty & Associates of Virginia, LLC; K&K Electric & Construction, LLC; JLH General Services, LLC; MBJ Electric, Inc.; LAF General Contractors, LLC; and BI&R Services, LLC.
The lawsuit concerned these above Defendants’ compliance with the following Washington, D.C. wage laws governing worker misclassification and wage violations: Workplace Fraud Act (“WFA”), D.C. Code § 32-1331.01, et seq.; and Minimum Wage Revision Act (“MWRA”), D.C. Code § 32-1001, et seq. None of the Defendants has admitted liability. The parties chose to settle this case to avoid the risks and expenses of litigation. On July 30, 2024, the D.C. Superior Court entered a Consent Order memorializing the parties’ agreement and authorizing these settlement payments.
If you worked on one of Power Design’s worksites in the District of Columbia as an hourly worker between May 4, 2019, and July 30, 2024, and believe you should have received a settlement payment, please provide the following information to pdisettlement@ilymcases.com: full name, mailing address, phone number, contractor for which you performed work, the project on which you performed work and its location, and the approximate time period during which you performed that work.
